Domestic Partner Health Benefits

This Practice Note provides an overview of the issues that arise for employers when providing health benefits to employees' domestic and civil union partners and same-gender spouses. It identifies various types of federal and state relationship recognition laws, summarizes the federal tax implications of providing domestic partner health benefits and discusses the impact of domestic partner status on other employee benefit programs such as cafeteria plans, medical expense reimbursement plans and on health coverage-related rights such as COBRA and HIPAA.
