Title I of the Employee Retirement Income Security Act (ERISA): Overview

This Note provides a very general overview of how and to what extent Title I of the Employee Retirement Income Security Act of 1974 (ERISA) applies to certain employee benefit plans sponsored by private sector employers. It introduces several key concepts such as fiduciary duties, preemption and prohibited transactions. This Note also examines elements of ERISA's enforcement structure, including civil actions and penalties assessable by the Department of Labor.
