Trademark Coexistence Agreement

A sample agreement between two parties setting out each of their rights, restrictions and obligations concerning marketplace coexistence of their respective trademarks in the context of resolving a dispute. Trademark coexistence agreements vary in length and complexity based on many factors, including the relationship and relative bargaining power between the parties, the nature and similarity of the marks, the types of products or services offered under the marks, and the territory covered by the agreement.
